2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 30.08.2023 passed in Cr. Misc. No. 56258 of 2023.

3. The petitioner seeks regular bail in a case registered for the offence under Sections 384, 386/34 of the Indian Penal Code and Section 17 of the C.L.A. Act.

4. The following order was passed on 30.08.2023 in Cr. Misc. No. 56258 of 2023:- "Heard learned counsel for the petitioner and learned APP for the State.

2. This application for grant of regular bail arise out of Wazirganj P.S. Case No. 220 of 2014 registered for the offence punishable under Sections 384, 386, 34 of the Indian Penal and Section 17 of C.L.A. Act.

3. As per prosecution case, petitioner is that he along with accused persons being naxalite

Patna High Court CR. MISC. No.26510 of 2024(2) dt.21-06-2024 2/2 have demanded extortion money and on nonpayment of the extortion money, they threatened the contractor and also burnt the J.C.B machine and tractor of the contractor.

4. Petitioner is the named accused in the aforesaid F.I.R and he has criminal antecedents of similar nature and he is an absconder.

5. In view of the aforesaid fact, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, the prayer of bail of the petitioner is rejected herewith. "

5. No ground for review is made out.

6. Accordingly, this application for regular bail is hereby rejected.
