JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 118/119/120B/420/467/468/471/34 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

The prosecution case is that the photographs and identity card of N.I.T. College, Patna of the son of the informant namely Himanshu Kumar were taken by the officers of the Rajgir branch of HDFC bank for opening of the bank account but the authority of the bank did not return the same, when demand being made by the informant, the Branch Manager and other staff of the bank misbehaved and abused the informant by calling caste name.

No.37769 of 2015 (2) dt.18-09-2015 2/2 It is submitted by learned counsel for the petitioner that since the Branch Manager received complaint from the Superintendent of Police, Barmer with regard to the fraudulent withdrawal being made by opening of forged accounts including the accounts in the name of the son of the informant, hence, the photographs and identity card of the son of the informant were retained by the bank authority. The letter of the Superintendent of Police, Barmer has been brought on record as annexure-4 to the petition.

Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Biharsharif, Nalanda in connection with Rajgir P.S. Case No.295 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
