JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being father of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant after one year of marriage for non fulfillment of dowry demands.

It is submitted by the learned counsel for the petitioner that due to pre-mature death of the husband of the victim, her pregnancy got terminated due to shock as a result she committed suicide and maliciously the present case has been lodged. It is further submitted that subsequently the informant has retracted from the initial version and has filed a petition to that effect before

Patna High Court Cr.Misc. No.36411 of 2015 (2) dt.09-09-2015 2/2 the learned court below. Considering the above facts, wife of the petitioner has been granted anticipatory bail vide Cr. Misc. No. 17904 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Samastipur in connection with Patori P.S. Case No.90 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
