The petitioner apprehends his arrest in a case registered for the offence under Section 364/34 of the Indian Penal Code.

As per F.I.R., some unknown persons kidnapped and killed the son of the informant.

It is submitted on behalf of petitioner that name of the petitioner transpired during course of investigation on the basis of statement of so called spy. Even, the informant has not stated anything against petitioner in the re-statement and only on the submission of spy, name of petitioner has come. No motive has been assigned. Petitioner has clean antecedent. However, learned A.P.P. for the state has opposed the prayer and submitted that during course of investigation, it has
