Smt Pushpa Sinha, APP ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 06-10-2018 I have heard learned counsel for the petitioners and the State.

The petitioners seek bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 40 litres 500 Ml. of foreign liquor was recovered from beneath of the seat of the bus from which the petitioners were travelling. It is contended that nothing has been recovered from the conscious possession of the petitioners and they have been falsely implicated in the present case only on the basis of suspicion. Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Nawada, in connection with C.I.S. No. 728 of 2018 (arising out of G.O. Case No. 238 of 2018).

If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
