1. Heard learned counsel for the petitioner and learned GP-14 for the State.

2. Learned counsel appearing on behalf of the petitioner submits that the instant contempt application has been filed for initiating a proceeding of contempt against the contemnor/opposite parties for their deliberate and willful violation of the order dated 27.11.2024 passed in C.W.J.C. No. 17800 of 2024. It is further submitted that C.W.J.C. No. 17800 of 2024 was filed for a direction upon the Circle Officer, Rahika to get the land of the petitioner measured in view of Annexure-P/6 of the writ application, i.e., the order contained in memo no. 1371 dated 23.07.2024 issued by the

Patna High Court MJC No.1015 of 2025(5) dt.05-12-2025 2/2 Circle Officer, Rahika whereby the Circle Officer had directed his subordinates to get the land of the petitioner measured but then the same till date has not been done.

3. At this stage, learned counsel appearing on behalf of the State submits that the order dated 27.11.2024 passed in C.W.J.C. No. 17800 of 2024 stands complied with and the land of the petitioner has been measured.

4. Learned counsel appearing on behalf of the petitioner does not dispute the said submission of the learned counsel appearing on behalf of the State but then submits that the land has been wrongly measured on which learned State Counsel submits that if the petitioner is aggrieved by the measurement of the land then he has remedy of assailing the same before an appropriate forum in accordance with law.

5. After hearing the learned counsel for the parties, the Court is satisfied with the stand taken by the State, as such, the contempt application is dismissed.

6. However, the same would not preclude the petitioner from assailing the measurement report in accordance with law before an appropriate forum.
