JUSTICE SUDHIR SINGH ORAL ORDER 14-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case (S.T. no.91/2015/Tr. No. 466 of 2015 arising out of Bounsi P. S. Case no. 122 of 2014, G.R. no. 1443 of 2014) instituted under Sections 304B, 201 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he along with his other family members had killed sister of the informant on account of non-fulfilment of demand of dowry.

Earlier bail application of the petitioner was rejected vide Annexure-1 to the present application. This is the second attempt for bail on behalf of the petitioner. A report was called for from the trial court regarding stage of the case, same is at flag 'A' to the present application. It has been reported that out of ten prosecution witnesses, eight witnesses have already been examined and within a period of three months the trial is expected to be concluded.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner, same is rejected. The trial court at Banka is directed to take all necessary steps to ensure that the remaining witnesses are examined within a

Patna High Court Cr.Misc. No.30939 of 2016 (3) dt.14-09-2016 2/2 period of four months from the date of receipt/production of a copy of this order. The District Magistrate and Superintendent of Police, Banka, are also directed to ensure that the official witnesses are produced in the court on the date fixed by the trial court so that the trial could be concluded within the stipulated period.
