Petitioner Vinod Sharma apprehends his arrest in a case under Section 302 and other sections of the Indian Penal Code.
The petitioner along with other accused persons is alleged to have come at the house of the informant. The accused persons are alleged to have looted different articles from the house of the informant and also assaulted the informant Suraj Das and his sons. Learned counsel for the petitioner submits that of course the petitioner is named in the F.I.R. but no specific allegation is made against the petitioner. Similarly situated accused persons, namely, Prakash Kumar @ Prakash Sharma, Dhiraj Sharma, Jagat Sharma @ Jagat Narayan Sharma, Basudeo Sharma, Rameshwar
Patna High Court Cr.Misc. No.36130 of 2015 (3) dt.03-11-2015 2/2 Sharma and others were granted anticipatory bail by other bench of this Court vide orders passed in Cr. Misc. Nos. 39505/2015, 37259/2015, 40445/2015, 20545/2015 and Cr. Misc. No. 23786/2015. One of the co-accused, namely, Prakash Sharma has also been granted regular bail vide order passed in Cr. Misc. No. 25279/2015. The case of the petitioner stands on the same footing. The deceased got one injury on his head and 25 persons are alleged to have assaulted the deceased.
Learned A.P.P. did not dispute the aforesaid facts. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, District - East Champaran in Chhatauni P.S. Case No. 53/15, arising out of G.R. Case No. 1128/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
