Petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-B)a/26 of the Arms Act. Allegation is of recovery of one country made musket loaded with live cartridge from motorcycle bearing no. BR51A1657.

Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case on mere suspicion only. No incriminating material has been recovered from the possession of petitioner. The motorcycle in question from which loaded country made musket with live cartridge has been recovered does not belong to the petitioner. Petitioner is in custody since 06.01.2022.

No.20258 of 2022(2) dt.15-07-2022 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Amarpur P.S. Case No. 471 of 2021 (GR. No. 2554 of 2021), with following conditions:-

(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.

(2) The petitioners shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) ranjan/- U
