JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-10-2018 The petitioner seeks regular bail in connection with Masrakh P.S. Case No. 267 of 2018, registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30, 30(A), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 6000 litres of liquor and three persons were arrested.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing has been recovered from his conscious possession and he has no criminal antecedent and has been in judicial custody since 07.08.2018. Heard learned A.P.P. also.
Having heard both sides, considering the facts and

No.60628 of 2018 (2) dt.06-10-2018 circumstances of the case, at this stage, I am not inclined to enlarge the petitioner on bail rather this application is disposed of with direction to the court below to release the petitioner on bail once he completes three months in judicial custody.
