The petitioners seek bail in anticipation of their arrest in connection with Khagaria (Gangour) P.S. Case No. 785 of 2017 dated 08.11.2017 instituted for the offences under Sections 147, 148, 307, 324, 379, 448, 504, 506 and 34 of the Indian Penal Code.
The informant is alleged to have been assaulted at the hands of the petitioners and others. The specific
Patna High Court CR. MISC. No.19263 of 2019(2) dt.02-04-2019 2/2 act of assault and of taking away the gold ornament are on two other accused persons and not the petitioners. There is a counter version of the occurrence also vide Khagaria P.S. Case No. 786 of 2017. The victim/informant appears to have received simple injuries.
Considering the aforestated aspects of the case, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 785 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
