JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 419,420,406,468 and 471/34 of the Indian Penal Code. The accusation against the petitioner is of receiving benefits under Indira Awas scheme twice. Though notices were issued to the petitioner and others to return the amount but when they did not return the amount, the FIR was lodged. It is submitted by the learned counsel for the petitioner that though a certificate proceeding has been initiated against the petitioners undertakes to deposit Rs.30000/- in two installments
Patna High Court Cr.Misc. No.33875 of 2014 (2) dt.02-03-2015 2/2 within four months from today before the learned court below which will be invested in some fixed deposit scheme in connection with the present case which will be subject to the result of the case.
Considering the present stand of the petitioner, let the above named petitioners be released on provisional anticipatory bail for four months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda in connection with Bind P.S. Case No. 1 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail will be confirmed by the learned court below on deposit of the above amount within four months. (Dinesh Kumar Singh, J) Anil/- U T
