The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 365/34 of the Indian Penal Code.
It is alleged that husband of the informant went traceless on 27.04.2014. When suspicion was raised against petitioner and others.
It is submitted by the learned counsel for the petitioner that the husband of the informant was traceless on 27.04.2014 when the First Information Report was registered on 04.05.2014 and from the record it appears that the informant was on inimical terms with the husband of the informant since Sabour P.S. Case No. 93 of 2013 had been registered against the victim by the wife of the petitioner.
Patna High Court Cr.Misc. No.34813 of 2015 (2) dt.01-09-2015 Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Similarly situated coaccused Janardan Paswan & Another has been granted bail vide Cr. Misc. No. 12406 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Md. Salim, Judicial Magistrate, Ist Class, Bhagalpur in connection with Sabour P.S. Case No. 106 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
