JUSTICE SUDHIR SINGH ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 302 and 201/34 of the I.P.C. The prosecution story, in brief, is that the informant's daughter was married with the petitioner nine years ago and his daughter gave birth to two daughters and due to non-production of male child the petitioner including co-accused tortured his daughter and ultimately killed his daughter and discriminated her dead body.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.2.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of

Patna High Court Cr.Misc. No.30573 of 2016 (3) dt.08-09-2016 2/2 witnesses alleged against the petitioner. The alleged occurrence is said to have taken place after nine years of marriage. There are two daughters of the deceased. They have been examined in course of investigation along with the other witnesses, whose statements are in paragraphs 17, 18, 19, 38 and 39 of the case diary. It has been stated by the said witnesses that while she had gone to fetch water from the hand pump, she had sustained injury as she fell down. She was taken for treatment but she could not survive.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge VIth, Madhubani in connection with Raj Nagar P.S. case No.29 of 2016 (G.R. No.247 of 2016) corresponding to S.T. No.162 of 2016. (Sudhir Singh, J) Narendra/- U T
