The petitioner apprehends his arrest in connection with Ahiyapur P.S. Case No. 388 of 2014 registered under Sections 302, 120B, 34 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that on perusal of F.I.R. itself, it appears that there is no specific allegation against the petitioner. One coaccused Guddu Singh had taken money from the deceased and on demand, he has taken lame excuses. Further submission is that in course of investigation, in paragraph nos. 5, 6, 10 and 11 of the case diary, neither the informant nor brother of the deceased has

Patna High Court Cr.Misc. No.4222 of 2017 (5) dt.20-04-2017 2/2 stated the name of this petitioner. It is also submitted that final form has been submitted in this case.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Muzaffarpur in connection with Ahiyapur P.S. Case No. 388 of 2014, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
