The petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case No. 490 of 2018 corresponding to Special Case No. 9171/18 registered for the offence punishable under Sections 30(a)(c) (d)/34/36 of Bihar Excise Prohibition Act and Sections 25(1-b) A/36/35 of the Arms Act. Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case merely on the basis of suspicion. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from the poultry farm which is lying in abandoned condition for the last five years. Considering the facts and circumstances of the case, let the above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Court, Patna in connection with Bakhtiyarpur P.S. Case No. 490 of 2018 corresponding to Special Case No. 9171 of 2018 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
