2. The petitioner apprehends arrest in connection with Tiyar P.S. Case No. 94 of 2024 dated 08.12.2024, instituted for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118, 109, 352, 351(2) of the B.N.S.
3. The allegation against the petitioner is that he assaulted with butt of the pistol on the head of the informant due to which he sustained head injury.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that both the sides are agnates/cosharers. It is further submitted that the injury report reveals that the injury is simple in nature caused by hard and blunt
Patna High Court CR. MISC. No.18729 of 2025(3) dt.02-07-2025 2/2 substance. Learned counsel further submitted that there is a case and counter case between the parties. Counter case bearing Tiyar P.S. Case No. 95 of 2024 has been lodged by Saraswati Kunwar (family member of petitioner) against informant and others. Lastly, it has been submitted that petitioner has no criminal antecedents.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Tiyar P.S. Case No. 94 of 2024, he/they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. IXth Bhojpur at Ara, subject to condition as laid down under Section 482(2) of the B.N.S.S.
