JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-08-2016 Heard the learned counsel for the petitioner, the informant and the State.

The petitioner, being the husband of the informant, is languishing in custody since 30.04.2016 in a case registered under Sections 342, 323, 506, 498A and 34 of the Indian Penal Code. The basic accusation is of torture for non-fulfillment of dowry demand after sixteen years of marriage. The learned counsel for the petitioner submits that petitioner admits his marriage with the informant having three children. Earlier also Buddha Colony P.S. Case No. 291 of 2013 was filed with same accusation by the mother of the petitioner which ended in compromise. The learned counsel for the petitioner submits that the petitioner is still ready to keep his wife with full dignity and honour. The learned counsel for the informant also submits that the informant is also ready to accept the offer.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the

Patna High Court Cr.Misc. No.36360 of 2016 (2) dt.23-08-2016 like amount each in connection with Buddha Colony P.S. Case No. 101 of 2016 to the satisfaction of Smt. Ritu Kumari, Judicial Magistrate, 1st Class, Patna.

It is expected from the learned Court below to get the issue reconciled between the parties. Both the sides agree to appear before the lower Court on 9th September, 2016. (Dinesh Kumar Singh, J) SA/- U √ T √
