The petitioner is languishing in custody for the offences punishable under Sections 364A/120B/34 of the Indian Penal Code.
The FIR relates to kidnapping of the father of the informant for ransom.
The impugned order reveals that the informant's father had gone to receive rupees twenty lacs, the ransom amount and they were apprehended by the police.
Learned counsel for the petitioner submits that the statement of the victim, recorded under Section 164 Cr.P.C., would reveal that the victim has received rupees five lacs from coaccused Ranaji for ensuring employment in government job and
Patna High Court Cr.Misc. No.57132 of 2018 (2) dt.20-09-2018 P2/ just to recover that amount the petitioner and others had taken him on the pretext of compromise. The accused person wanted recovery of rupees twenty lacs.
Considering the admission of the victim aforesaid, which is background of the allegation as well as facts that the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Beur P.S. Case No.158 of 2018, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
