The petitioners seek bail in connection with Buniyadganj P. S. Case No.42 of 2020, instituted for the offences under Sections 147, 148, 149, 448, 341, 323, 504, 326, 302 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners are in custody since 06.01.2021, they are persons with clean antecedents and charge-sheet has been submitted in this case.

Allegation as alleged by the informant is that his sonin-law came to his sasural on the eve of Holi, when there was a

No.29999 of 2021(3) dt.23-12-2021 2/3 quarrel between him and Suraj Manjhi and Ram Babu Manjhi during D.J. programme on account of which, the named accused persons forcibly took away son-in-law and started assaulting him and thereafter took him away. It is further alleged that thereafter the informant started searching his son-in-law and his body was found lying in a field.

The learned counsel for the petitioners submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that a quarrel had taken place in D.J. programme on account of which, the named accused persons assaulted the deceased. It is submitted that no one has seen the occurrence. During course of investigation also, it has not come that who assaulted the deceased in such a manner that he ultimately died.

The learned counsel for the petitioners submits that in the investigation also, the allegations are general and omnibus in nature. No specific allegation is against any one of the accused persons.

Learned A.P.P. opposes the bail application, but fairly submits that during the course of investigation also, the allegations, which has come, are general and omnibus in nature. Considering the fact that the petitioners are in custody

No.29999 of 2021(3) dt.23-12-2021 3/3 since 06.01.2021, they are persons with clean antecedents and charge-sheet has been submitted in this case, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Gaya in connection with Buniyadganj P. S. Case No.42 of 2020.

The application stands allowed.
