The petitioner, who is in custody, seeks bail in connection with Saharsa Sadar P.S. Case No. 486 of 2018 registered for the offence punishable under Sections 457, 380 of the Indian Penal Code.

FIR was lodged against unknown persons. It is alleged in the FIR that on 25.04.2018 at 2.00 PM he was playing cricket with his brother and the ball went in the house of owner and when he went to bring the ball, he found the lock to be broken, then he informed his elder sister, and house owner was not living there for last four months.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.60196 of 2018(2) dt.11-10-2018 2/2 petitioner is quite innocent and has been falsely implicated in this case only on suspicion. His name has surfaced during the course of investigation. Nothing has been recovered from his possession and he has not been put on T.I.P. Petitioner is in custody since 12.07.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Saharsa Sadar P.S. Case No. 486 of 2018.
