Petitioner seeks bail in a case registered for the offence punishable under Sections 302, 406, 34 and 120B of the Indian Penal Code.
As per FIR, 14 named accused persons including the petitioner, armed with weapons, surrounded the father of the informant and made indiscriminate firing in which informant's father died.
Learned counsel for the petitioners submits that the allegation of firing is general and omnibus and there is no specific allegation of firing against the petitioners and similarly situated co-accused Bhagat Yadv and Pawan Yadav have been granted bail by a co-ordinate bench of this Court vide order dated 01.07.2021 passed in Criminal Miscellaneous No. 15438
Patna High Court CR. MISC. No.19867 of 2022(2) dt.11-07-2022 2/2 of 2021 as well as co-accused Ashok Yadav has also been granted bail vide order dated 9.4.2021, passed in Cr.Misc.No. 3392 of 2021 as well as. Petitioner has got no criminal antecedent and is in custody since 15.12.2021. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Laukaha P.S. Case No. 134 of 2020, with following conditions:-
(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.
(2) The petitioner shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) ranjan/- U
