JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-07-2023 At the outset, learned counsel for the petitioners seeks permission to withdraw this petition, so far as petitioner no. 1 Ram Kumar Sah is concerned.

2. Accordingly, in respect of petitioner no.1, this petition is dismissed as withdrawn.

3. The petitioner (i.e. petitioner no. 2) apprehends his arrest in a case registered for the offence under Sections 341, 342, 323, 307, 354(B), 427, 379/34 of the Indian Penal Code.

4. As per F.I.R., specific accusation of assault is against co-accused Ram Kumar Sah. So far as this petitioner is concerned, there is general and omnibus allegation. Petitioner (i.e. petitioner no. 2) is own cousin of the informant. Petitioner claim clean antecedent.

5. Learned A.P.P. for the State and learned counsel for the informant vehemently opposed the prayer for anticipatory bail.

6. Considering the fact that there is general and omnibus allegation against petitioner coupled with the fact that petitioner has got clean antecedent, let the petitioner namely Raushan Kumar Sah, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Jhanjharpur, District - Madhubani in connection with Andhrathardhi P.S. Case No. 93 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
