JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)A, 26, 35 of the Arms Act.

Three live cartridges are said to have been recovered from conscious possession of the petitioner when he as well as other F.I.R. named accused were arrested by the police. Petitioner is in jail custody since 17.11.2015.

No doubt, petitioner carries criminal antecedent of several cases but taking note of his period of detention as well as facts and circumstances of the case, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand)

Patna High Court Cr.Misc. No.31267 of 2016 (2) dt.11-08-2016 2/2 with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 319 of 2015.
