The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 409, 34 of the Indian Penal Code.

The prosecution case as per F.I.R is that the petitioner being Secretary of Ward Implementation & Management Committee in connivance with the President of the aforesaid Committee has withdrawn the money which was allotted under NalJal Yojana and Gramin Nali-Gali Pakki Karan Yojana. It is submitted by learned counsel for the petitioner that thrust of accusation is against the President of the aforesaid Committee. The petitioner has only a limited role in execution

It is further submitted that petitioner has withdrawn Rs. 50,000/- for execution of the work in question and payment of wages to the labourers. However, the petitioner is ready to deposit Rs. 50,000/- in the account of the Ward Implementation & Management Committee. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahna, Dhaka, East Champaran in connection with Kundwa Chainpur P.S. Case No.

142 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The bail bonds of the petitioner shall be accepted by the learned Court below on showing receipt of the deposit. The aforesaid payment will be subject to final outcome of the case.
