JUSTICE MADHURESH PRASAD ORAL ORDER 17-08-2022 Heard learned counsel for the petitioner and learned counsel for the informant as well as learned APP for the State. This Court would expect that the petitioner's Counsel would honour his undertaking in the instant proceedings regarding supply of requisite court fee etc. within two weeks from the date he is called upon to do so by the office. Petitioner seeks bail in connection with Bikram P.S. Case No. 296 of 2019 registered under Sections 304B, 302 and 34 of the Indian Penal Code.
The petitioner has renewed his prayer for bail. Petitioner's earlier prayer for bail was rejected vide order dated 08.09.2020 passed in Cr. Misc. No. 21185 of 2020, since it was revealed in investigation that the deceased died on
Patna High Court CR. MISC. No.20520 of 2022(5) dt.17-08-2022 2/2 account of asphyxia at her matrimonial home and the petitioner is husband of the victim.
Petitioner's counsel submits that he has remained in custody now for three years.
The learned counsel for the informant submits that he will take all steps to ensure conclusion of trial on day to day basis. In view of such submission, this Court, for the present again, is not inclined to allow the petitioner's prayer for bail. This application is rejected with observation that the trial court should proceed in the matter expeditiously without granting any unnecessary adjournment or undue delay, in accordance with law.
