The petitioner is in custody since 27.07.2018 in connection with Mehandiganj P.S. Case No. 54 of 2018 for the offence registered under Section 30 (a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recovery was not made from the conscious possession of the petitioner but he was remanded and, thereafter, he has remanded for other similar case in Mehandiganj P.S. Case No. 56 of 2018 under the other similar Sections of the Excise Act in which he is on bail.

Considering the fact that the alleged recovery was not made from the conscious possession of the petitioner, let the

No.57785 of 2018(2) dt.20-09-2018 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Patna, in connection with Mehandiganj P.S. Case No. 54 of 2018.
