JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-08-2015 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks bail in connection with Sessions Trial No.1183 of 2013 arising out of Athmalgola P.S. Case No. 69 of 2013 registered for the offences punishable under sections 302 read with 34 of the Indian Penal Code as well as section 27 of the Arms Act.
The prayer for bail of the petitioner was twice rejected by this Court earlier. According to the prosecution case the petitioner is said to be the main assailant of the deceased. It would appear from a report dated 6.8.2015 submitted by the trial court that altogether five witnesses have already been examined during trial.
Patna High Court Cr.Misc. No.33826 of 2015 (3) dt.19-08-2015 2/2 Taking into consideration serious nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.
The trial court is directed to expedite the trial and conclude the same as early as possible.
