The petitioner seeks regular bail in connection with Madhepur P.S. Case No. 6 of 2016, registered for the offence punishable under Sections 467, 468, 409, 406, 34 of the Indian Penal Code.

The allegation is regarding the accused persons having conspired and withdrawn a sum of Rs. 50,000/- from the bank account belonging to the wife of the informant pertaining to the Indira Awas Yojna.

The learned counsel for the petitioner submits that the petitioner has already deposited the said amount of Rs. 50,000/- in the bank account and on account of such deposit, co-accused person has already been granted

Patna High Court CR. MISC. No.19949 of 2019(2) dt.05-04-2019 2/2 anticipatory bail vide Annexure-2 series to the present bail petition, hence, the petitioner be granted the privilege of regular bail. It is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 24.12.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, 1st Jhanjharpur, DistrictMadhubani in connection with Madhepur P.S. Case No. 6 of 2016.
