The petitioners apprehend their arrest in Singhia P.S. Case No. 17 of 2022, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

As per the prosecution case, six FIR named accused persons including petitioners and 3-4 unknown persons abused and assaulted the informant, his sons and daughters, as a result of which five persons sustained injuries.

It is submitted that allegation of commission of

Patna High Court CR. MISC. No.20549 of 2022(2) dt.01-09-2022 2/2 assault is general and omnibus. Injuries of the injured are simple in nature. Admittedly, there is land dispute between the parties on account of which the alleged occurrence took place. There is case and counter case. Both sides sustained injuries. Petitioners claim clean antecedent.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Rosera, Samastipur in connection with Singhia P.S. Case No. 17 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
