ANJANA MISHRA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 27.08.2018 in connection with Barharia P.S. Case No.422 of 2017, G.R. No.6196 of 2017 registered for the offence under Sections 272, 273 and 308 of the Indian Penal Code and Sections 35(A), 35(B), 36, 41(i) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the recoveries were made from the joint property of the house of the petitioner and the petitioner has nothing to do with the alleged recoveries. It is further submitted that only on suspicion the petitioner has been taken into custody.

In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand)

Patna High Court Cr.Misc. No.57797 of 2018 (2) dt.20-09-2018 2/2 with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-2nd, Siwan, in connection with Barharia P.S. Case No.422 of 2017, GR. No.6196 of 2017.
