JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 379, 504 and 506 of the Indian Penal Code.

It is alleged that the student leader Ramanand Yadav came to the room of the informant in the mid-night and on the point of pistol, snatched gold chain and on protest being made, he assaulted the informant. The petitioner and others also assaulted the informant with iron rod causing injury on his head and they also took away the laptop of the informant.

It is submitted by learned counsel for the petitioner that accusation of assault is omnibus and general against all the accused persons and the injury report of the informant reflects only one injury, though opinion of the same has been kept

Patna High Court Cr.Misc. No.34679 of 2015 (2) dt.17-08-2015 2/2 reserved. There is counter version of the occurrence also and petitioner's side also received injury. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with M.U. P.S. Case No. 29 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
