2. The petitioner has preferred this application for grant of regular bail in connection with Siwan (Excise) P.S. Case No. 114 of 2026 dated 12.02.2026 registered for the offences punishable under Sections 30(a) and 47 of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, petitioner is alleged to be driver of the vehicle from which altogether 432 liters of illicit foreign liquor has been recovered.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It is further submitted that petitioner is in custody since 13.02.2026 and having no criminal antecedent. Moreover, no

Patna High Court CR. MISC. No.18881 of 2026(2) dt.25-03-2026 2/2 procedure as prescribed under Section 105 of B.N.S.S. has been followed and the petitioner was not aware that the alleged consignment was that of illicit liquor.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case as well as period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Siwan in connection with Siwan (Excise) P.S. Case No. 114 of 2026.

7. The application stands allowed.
