JUSTICE SUDHIR SINGH ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. Allegation is that brother of the informant was killed by miscreants as, being posted at Block Panchayat Sewak, the deceased complained to the higher authorities about withdrawal of money from the fund of development works.

It has been submitted on behalf of the petitioner that he is in custody since 19.8.2015. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. The name of the petitioner has come on the basis of confessional statement of the co-accused. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest implication of the petitioner in the present case. Other co-accused has been granted bail vide Cr. Misc. no. 10222 of 2014.

On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.29512 of 2016 (3) dt.05-09-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhubani, in connection with Ghoghradiha P.S. Case no. 83 of 2013 , G.R. no. 1174 of 2013.
