JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Gopalganj Town P.S. Case No. 148 of 2018 registered for the offence punishable under Section 366A of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of minor daughter of the informant.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he has no criminal antecedent and both the parties have compromised the case.

Heard learned APP also, who has opposed the prayer for anticipatory bail stating that the victim girl has not been recovered as yet.

Patna High Court CR. MISC. No.18007 of 2019(3) dt.17-06-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if petitioner surrenders and makes pray for regular bail, the same shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
