JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 31-01-2017 Heard learned counsel for the petitioners and learned counsel representing the State.
Petitioners apprehend their arrest in connection with Deo P.S. Case No. 61 of 2016 registered for the offences punishable under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.
Allegedly, for flowing drain water altercation took place and the petitioners and co-accused armed with lathi assaulted the informant and his father on head with intention to kill. Submission is of false implication and that no offence under Section 307 IPC is made out, the allegations are omnibus and general in nature, the petitioners have got no criminal antecedent and the injuries found on the person of the informant
Patna High Court Cr.Misc. No.2745 of 2017 (2) dt.31-01-2017 and father are simple in nature caused by hard and blunt substance.
Learned APP duly assisted by learned counsel for the informant opposes the prayer of pre-arrest bail by submitting that on head injury has been found.
In the facts and circumstances stated above, considering that for petty dispute the occurrence has taken place, the injuries found on the person of the informant and his father are simple in nature, the petitioners above named, in case of their surrender or arrest within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Deo P.S. Case No. 61 of 2016, subject to the conditions as laid down under Section 438
(2) of the Cr.P.C.
