Petitioner seeks bail in connection with Kesariya P.S. Case No. 171 of 2018 registered for the offence punishable under sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016 Learned counsel appearing for the petitioner submits that Petitioner has falsely been implicated in this case due to police mechanism and maneuvering. He has no concern with liquor in question. Petitioner has not been arrested at the spot nor anything has been recovered from his conscious possession. Petitioner has no criminal antecedent and is in custody since 17.07.2018.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the

Patna High Court Cr.Misc. No.58294 of 2018(2) dt.28-09-2018 2/2 petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Motihari, East Champaran in connection with Kesariya P.S. Case No. 171 of 2018.
