Petitioner seeks bail in connection with Siwan Muffasil P.S. Case no. 37 of 2021 registered for the offence punishable under sections 302, 120B, 341, 323, 307, 504,506, 379, 354//34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 21.1.2021, is person with clean antecedent and charge sheet has been submitted. It is further submitted that in the FIR the informant alleges that Arun Kumar Yadav assaulted the husband of the informant by hockey stick on which he fell down and died, petitioner is alleged to have assaulted the son of brother-in-law of the informant along with

Learned counsel submits that from perusal of the allegation as alleged in the FIR, it would manifest that it was Arun Kumar Yadav who is alleged to be assailant of the husband of the informant and as far as allegation against the petitioner is concerned, he along with others assaulted the son of brother-in-law of the informant.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody, is person with clean antecedent and charge sheet has been submitted, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Siwan Muffasil P.S. Case no. 37 of 2021.
