The petitioner is accused in connection with Muffasil P.S. Case No. 329 of 2015 registered under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather in course of investigation only suspicion has been raised by the brother of the informant which would appear in paragraphs 19 and 20 of the case diary to the effect that the deceased was seen with this petitioner except that there is nothing against him. No.27564 of 2016 (2) dt.11-07-2016 accused, Vishwanath Choudhary, has already been granted privilege of bail by a Bench of this Court vide order dated 28.04.2016 passed in Criminal Misc. No. 17603 of 2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Motihari, in connection with Muffasil P.S.
