The petitioner apprehends his arrest in connection with Rail Jehanabad P.S. case No. 28 of 2016 instituted under Sections 498(A), 306/34 of the Indian Penal Code. The allegation, in brief, is that the petitioner and other family members tortured the deceased and on account of that she committed suicide on railway track. It is submitted that never any demand was made or torture was done. She was of unsound mind and was run over by train while crossing the railway track and the petitioner husband is a poor labourer and there was no any earlier complaint of torture.

Considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.1275 of 2017 (3) dt.07-02-2017 2/2 of the case, let the petitioner, namely, Ramjee Yadav in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Magistrate, Gaya in connection with Rail Jehanabad P.S. case No. 28 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
