Patna High Court CWJC No.6656 of 2020(3) dt.16-08-2021 2/3 petitioner, Mr. S.D. Yadav, learned AAG-9 for the State and Mr. Nirmal Kumar learned counsel appearing for the Bihar State Food and Civil Supplies Corporation Ltd., Sitamarhi.

2. This writ application has been filed by the petitioner for a direction to the Respondent No. 2 i.e. the Secretary, Department of Co-operative Societies, Government of Bihar, Patna, to dispose the appeal filed by the petitioner on 2.9.2019 at Annexure-8 against the impugned order dated 6.8.2019 vide Memo No. 7494 passed by the Registrar, Cooperative Societies, Patna, (Respondent No. 3) whereby the entire pension of the petitioner has been withheld.

2. Learned counsel for the petitioner submits that the appeal filed by the petitioner is pending since 2019 and the concerned authority may be directed to dispose the appeal within a reasonable time frame.

3. Mr. S.D. Yadav, learned AAG-9 for the State appears and submits that respondent No. 2 may be directed to dispose the appeal within a period of two months.

4. Mr. Nirmal Kumar, learned counsel appearing for the Respondents No. 8 and 9 is present.

5. Having regard to the submission made by the parties and in view of the prayer made by the petitioner, this

Patna High Court CWJC No.6656 of 2020(3) dt.16-08-2021 3/3 writ application is disposed of with a direction to the Respondent No. 2, i.e. the Secretyary, Department of Cooperative Societies, Government of Bihar, Patna, to consider and decide the appeal filed by the petitioner in accordance with law within a period of three months from the date of receipt/production of a copy of this order.

6. With aforesaid observation/direction, this writ application is, accordingly, disposed of.
