2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 394 of the Indian Penal Code registered in connection with Rasalpur P.s.Case No. 08 of 2024.
3. The learned counsel for the petitioner has submitted that by a common order dated 28.10.2024 passed in Cr.Misc. No.42153 of 2024 and its analogous cases, four regular bail applications were disposed of. Other three accused persons, were granted bail, but the prayer for bail of the present petitioner was rejected on the ground that, according to his confession in para-22 of the case diary, looted pick up van was recovered.

In order to verify the said fact, the case diary was called for which is available with the record which shows that para-22 of the case diary contains the confessional statement of co-accused Santosh Kumar. So far as the present petitioner is concerned, his confessional statement has not been recorded.
5. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Rasalpur P.S.Case No. 08 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
