Petitioner seeks bail in a case registered under section 307 and other minor sections of the Indian Penal Code and 3/ 4 of the Damage to Property Act as well as 61 of the Bihar Excise Act. One man was arrested by the police while he was selling toddy and on the next day, more than 250 persons including the petitioner assembled and attacked the police station and damaged public property.

Petitioner is in jail custody since 2.5.2016 and no specific overt-act has been attributed against him. However, petitioner does not have any criminal antecedent.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan
