The petitioner is apprehending his arrest in connection with Belaganj P.S. Case No. 187 of 2016 registered for the offences under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted on behalf of the petitioner that though he is named in the F.I.R., but there is no allegation against him and the allegation is against Sanjay Yadav and Bhola Yadav and the matter relates to purchase of some land due to which some civil dispute is going on between the parties. Heard the learned APP also, who opposed the prayer for anticipatory bail.

Having heard both sides and considering the aforesaid fact and in view of the fact that the petitioner is named in the F.I.R. I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected. Let the petitioner, named above, surrender in the court below i.e. Judicial Magistrate,

Patna High Court Cr.Misc. No.4236 of 2017 (2) dt.09-02-2017 2/2 1st Class, Gaya in connection with Belaganj P.S. Case No. 187 of 2016 and pray for regular bail which shall be considered on the basis of the material available on the record, without being prejudiced by this order.

With the above observations, this application is disposed of.
