The petitioners apprehend their arrest in a criminal prosecution registered under Sections 302,201 and 120(B) of the Indian Penal Code.

Taking into consideration the fact that the petitioners are named in the F.I.R. vide Annexure-1 as accused and they are alleged to have participated in the crime in question, this Court is not inclined to accede to the prayer made on behalf of the petitioners for grant of anticipatory bail in connection with Nawada Town P.S. Case No. 261 of 2014, pending in the court of learned Chief Judicial Magistrate, Nawada. Accordingly, their prayer for anticipatory bail is rejected.

However, if the petitioners surrender in the court below within a period of four weeks from today and, if so advised, apply for regular bail, then the same shall be considered on its own merit without being prejudiced/ influenced by the rejection of the present application.
