JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 456, 467, 468, 471 of the Indian Penal Code.
As per the prosecution case, this petitioner has issued a fake TDR bearing No. TDR/CBS AB-047774, account No. 591918442829 of Rs. 50,000/- to one Sabir who presented it for payment in Danapur branch of Indian Bank on 26.10.2021. Senior officer of the bank looked into the matter and came to the conclusion that TDR presented for payment was a fake one and signature thereon were also forged.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the
Patna High Court CR. MISC. No.20327 of 2022(3) dt.21-11-2022 2/2 case. It is submitted that Md. Sabir has already given a written application to the bank that maturity amount of fixed deposit is already transferred in his account and now he has no complaint against this petitioner. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.
Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Danapur, Patna in connection with Danapur PS case No. 19/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C.
