2. The petitioner apprehends his arrest in Sohsarai P.S. Case No. 171 of 2023 registered for the offence under Sections 406/420 and 409 of the Indian Penal Code.
3. As per the prosecution case, the petitioner has applied for loan before the Central Bank of India under the PMEGP Scheme for manufacturing Notebooks and Registers. On 04.09.2018, the bank sanctioned the loan and disbursed an amount of Rs. 11,40,000/-. It has been alleged that the loan amount was never used by the petitioner for business purpose rather it has been used for personal work.

4. Learned counsel for the petitioner submits that the allegation that petitioner diverted the money is not correct. The petitioner had started his business but during COVID period, his business suffered a loss due to which the regular installment could not be paid and the loan account was declared N.P.A. on 24th of April, 2023. He further submits that co-accused Raushani Kumari having similar allegation has already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 16.10.2023 passed in Cr. Misc. No. 62818 of 2023.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Regards being had to the submissions made by the parties and taking into consideration the fact that similarly situated co-accused has been granted bail vide order dated 16.10.2023 passed in Cr. Misc. No. 62818 of 2023, I am inclined to grant anticipatory bail to this petitioner.
7. Let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Biharsharif, Nalanda, in connection with Sohsarai P.S. Case No. 171/2023, subject to the
