JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-12-2022 The present writ petition has been filed for directing the respondents to pass a fresh order regarding conversion of his agricultural land into a commercial land as per the provisions contained in the Bihar Agriculture Land (Conversion For NonAgricultural Purposes) Act, 2010. The learned counsel for the respondent-State has submitted that the petitioner had applied for conversion of his agricultural land before the Sub-Divisional Officer, Khagaria and the Sub-Divisional Officer, Khagaria, by an order dated 26.06.2014, had directed the petitioner to deposit a sum of Rs. 6,04,450/-, for the purposes of conversion, however, the same
Patna High Court CWJC No.11758 of 2015(2) dt.20-12-2022 2/2 was challenged by the petitioner by filing a miscellaneous case bearing Miscellaneous Appeal No. 06 of 2014-15, before the learned Court of Collector-cum-District Magistrate, Khagaria, but the said miscellaneous appeal has also stood dismissed by an order dated 07.08.2018. The petitioner had then challenged the said order dated 07.08.2018, by filing a writ petition bearing C.W.J.C. No. 8629 of 2019, however, the said writ petition has also stood dismissed by an order dated 25.04.2019, passed by a Co-ordinate Bench of this Court, hence, it is submitted that the present writ petition has been rendered infructuous inasmuch as much water has flown since the present writ petition was filed way back in the year 2015.
Having regard to the aforesaid submissions made by the learned counsel for the respondent-State, this Court finds that the present writ petition has been rendered infructuous on account of the subsequent events, which have taken place during the pendency of the present writ petition, hence, the present writ petition stands dismissed.
