JUSTICE RAKESH KUMAR ORAL ORDER 14-09-2016 Heard Sri Ajay Mukherjee, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is the second attempt for grant of bail on behalf of the petitioner. Earlier, the prayer for bail of the petitioner was rejected vide order dated 03.12.2015 passed in Cr.Misc.No.52314 of 2015.

In this case, by order dated 31.08.2016 a report was called for from the court below regarding stage of the case, which has been received and kept at Flag-A. On perusal of the report dated 5th September, 2016, it is evident that out of eight witnesses; five witnesses have already been examined and bailable warrant has been issued against remaining witnesses, meaning thereby that trial is going on expeditiously.

Patna High Court Cr.Misc. No.33620 of 2016 (4) dt.14-09-2016 2/2 Keeping in view the fact that trial is going on, there is no reason to review my earlier order. The prayer for grant of bail of the petitioner again stands rejected. However, while dismissing the present petition, it is desirable to observe that that the learned trial Judge may take steps, so that the case may come to its logical end without unnecessary delay. The concerned Superintendent of Police is directed to ensure production of witnesses, as and when required by the trial court.

Let a copy of this order be sent to the concerned Superintendent of Police.
