JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-03-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sarmera P. S. Case No. 118 of 2016 registered for offences punishable under Sections 420, 409 and 120 (B) of the Indian Penal Code.

Accusation is that the petitioner being Block Agriculture Officer, Sarmera in collusion with Sri Ritesh Kumar, the then Agriculture Co-coordinator, Sarmera and Shri Abhimanyu Kumar, former Agriculture Counselor committed irregularities in providing the compensation for Crop damage in the financial year 2014-2015 to eleven farmers. Some farmers were given more compensation showing more area of agricultural land and some farmers were given less compensation showing less

Learned counsel appearing on behalf of the petitioner submits that petitioner being the Block Agricultural Officer only sanctioned the compensation to farmers relating to damage of their crops on the recommendation of farmer Counselor for the Financial year 2014-15. The District Agricultural Officer, Nalanda in enquiry found that the lapses was on the part of Abhimanyu Kumar, the then farmer Counselor, which would appear through letter No. 1693 dated 23.09.2016 addressed to District Public Grievance Redressal Officer, Nalanda, annexed at Annexure-3. Having considered the facts and circumstances of the case, let the petitioner, above named, in case of arrest or surrender within a period of six weeks be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Sarmera P. S. Case No. 118 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
